Can I legally sell medical marijuana on Craiglist in AZ?

The answer to that question is a big fat NO. Contrary to what many marijuana dealers apparently think, it is illegal to sell “medical marijuana” on Craiglist. There are very specific guidelines that medical marijuana dispensaries need to follow in order to legally operate their business in Arizona, not to mention the grueling application process they were required to go through before setting up shop.

What about for “donation” only?

While many Craiglist marijuana salesmen are attempting to bypass the sale of marijuana by asking for non-negotiable “donations,” AZ law enforcement isn’t holding back from pursuing prosecution.

On June 5, police officers contacted 34-year-old Joshua Hulse of Phoenix to purchase some of the “medical marijuana available for donations” that Hulse had advertised on Craiglist. After an undercover officer exchanged a “donation” for some marijuana, police pulled Hulse over, and he admitted to making marijuana transactions to “patients” through his online account.

Though Hulse was specifically arrested for the sale of an illegal substance, officers were also able to find more than a pound of marijuana, $5,500 in cash, and a small bag of meth in his possession. Hulse was subsequently booked into jail on several felony drug charges.

Possession of Marijuana for Sale in Phoenix, AZ

According to A.R.S. 13-3405, a person shall not knowingly possess marijuana for sale in Arizona.

Anyone found guilty of possessing less than 2 pounds of marijuana for sale in AZ is guilty of a class 4 felony. If the amount of marijuana is at least 2 pounds but less than 4 pounds, the offense is charged as a class 3 felony, and if the amount is over 4 pounds, the offense is charged as a class 2 felony in Arizona.

As you can see from the statute above, anyone found guilty of selling even an extremely small amount of marijuana can be charged with a class 4 felony.  Not only do class 4 felonies typically come with exorbitant fines, they can also come with jail or prison time.
