Man Arrested for Possession of Marijuana for Sale, Drug Paraphernalia, & a Bomb in Phoenix, AZ

by on November 13, 2013

Back in the summer, Phoenix police officers served a warrant at the home of 20-year-old suspected marijuana dealer, Todd Robertson. Though they found an unimpressive amount of marijuana, officers did locate a homemade bomb that technicians later said could have leveled the entire house.

Once inside the residence, police found two mason jars of weed that totaled less than two ounces, in addition to two digital scales and a detailed book of clients and their payment history. After further investigation, officers discovered guns, “heavy duty body armor,” and the bomb, which had to be removed by Phoenix PD’s bomb squad.

Robertson was subsequently arrested on charges of possession of drug paraphernalia, possession of marijuana for sale, and a felony weapons violation.

Possession of Drug Paraphernalia in Phoenix, AZ

In Arizona, anyone found guilty of possessing an object that is used to grow, inject, test, manufacture, or otherwise use or sell illegal drugs will be charged with a class 6 felony.

What objects are considered to be drug paraphernalia in AZ?

Common items of drug paraphernalia include, but are not limited to, the following:

  • Pipes
  • Bongs
  • Smoking or Carburetion Masks

Several of the items listed above can be used to inject or smoke legal substances, such as tobacco, so courts must consider other factors when determining whether or not an object is indeed drug paraphernalia. Those factors include, but are not limited to, the following:

  • The proximity of the object to illegal drugs at the time of discovery
  • Statements from the owner regarding the object’s use
  • The existence of drug residue on the object
