Medical Marijuana Cultivating Sites Must Be Registered in Phoenix, AZ

In mid-January, Phoenix police discovered and seized 650 marijuana plants in the West Valley.

According to authorities, a patrol officer was visiting a memorial site when he noticed a strong odor of marijuana. The smell led the policeman to a residence located near 26th Ave & McDowell Rd, where he found 58-year-old William Becker.

A search of the home turned up 300 marijuana plants, and after serving a warrant on Becker’s second residence, located near Thomas Rd & 30th Ave, officers found and seized another 350 plants. In total, police are valuing the seizure at $1.3 million.

Charges for Cultivating Marijuana in Phoenix, AZ

Becker was arrested on charges of possessing marijuana for sale and cultivating marijuana.

In the state of Arizona, it is illegal to cultivate marijuana unless it is in compliance with the Arizona Medical Marijuana Act.

Charges and penalties for illegally cultivating marijuana range depending on the amount of the substance found. If the amount is less than 2 pounds, it will likely be charged as a class 5 felony and may come with up to 2.5 years in jail. However, if the amount is over 4 pounds, the offense will likely be charged as a class 3 felony and can come with up to 12.5 years in prison.

In Arizona, a conviction of marijuana cultivation comes with a mandatory jail sentence as such offenders are not allowed to avoid incarceration through participation in a drug treatment program, a luxury allowed to those convicted of select drug offenses in AZ.

Registering a Cultivation Site in Arizona

According to AZ law, a person may cultivate medical marijuana if they are registered with the Arizona Department of Health Services (ADHS) and are cultivating marijuana plants for a qualifying patient’s medical use if a registered medical marijuana dispensary is not operating within 25 miles of the qualifying patient’s home.
