Drug paraphernalia covers a wide range of items that are used to manufacture, grow, inhale, inject, and test drugs. Any person who is found guilty of violating A.R.S. 13-3415 section A is guilty of a class 6 felony. All drug paraphernalia must be forfeited by the owner following a conviction.
The court uses a number of methods to determine whether an object is drug paraphernalia or not. Some of these methods include:
- Statements from the owner pertaining to the objects use.
- Prior convictions relating to drug offenses.
- The proximity of the object to drugs.
- The existence of any residue of drugs on the object.
Arizona Revised Statutes provides a general list of objects that are generally considered drug paraphernalia. Some of the more common items on this list include:
- Bongs
- Water Pipes
- Smoking and Carburetion Masks
- Pipes made out of any material
- Other objects or kits used for creating or using drugs.
More often than not, a person who is caught with drug paraphernalia is also caught with a drug of some kind. A first time offender will spend between 3 and 18 months in jail if convicted.
